Terms of use

Route built, content not written. This page is excluded from the sitemap and set to noindex. It cannot publish until counsel review is confirmed by ACHS. Every page needs a named approver before it goes live — DCH General Services §605.1.28 makes each published version a retained advertising record.

Terms of use set out the rules for using a website: what the content is and is not, who owns it, and the limits of any liability. For a health care site they also state that the content is general information rather than medical advice. These terms are in preparation and not yet in effect.

What this document must cover

Standard website terms, plus the health care clauses that carry the actual weight here.

The standard part.

  • Acceptance of the terms by use of the site, and the right to change them with an effective date
  • Ownership of content and marks, and what a visitor may and may not copy or reuse
  • Acceptable use, and prohibited use
  • Third-party links, and the absence of any endorsement implied by linking
  • Disclaimer of warranties, limitation of liability and indemnity, drafted to Georgia law
  • Governing law and venue, severability, and the whole-agreement clause
  • A contact route drawn from site config, not hard-coded into the page

The health care part, which matters more.

  • General information, not medical advice. Content describes a Medicaid program and how it works. It is not clinical advice, does not substitute for a clinician, and must not be relied on for a medical decision.
  • No provider-patient or case management relationship is created by using the site, reading a page, or submitting a general enquiry. The relationship begins through enrollment and a signed agreement.
  • Eligibility descriptions are not determinations. Explanations of income rules, the nursing-home level of care, the DON-R or the DMA-6 describe the rules in general. Only an assessment and Medicaid’s own review determine eligibility for any individual.
  • No outcome is promised. No statement on the site promises approval, a timescale, a service level or a result, and none should be read as doing so.
  • Do not send health information through the site outside the appropriate route. This mirrors the website privacy policy.

The last two clauses do double duty. Georgia DCH General Services §605.1.28.2 prohibits an EDWP provider from making any promised or implied guarantee of eligibility or outcome in its advertising, and every published version of this site is a retained advertising record. Having the no-determination and no-promise language in the terms is compliance hygiene, not decoration.

Questions people ask about this

Does reading this website create a relationship with the agency?

No. Reading a page, or submitting a general enquiry form, does not create a provider-patient or case management relationship. That relationship begins through enrollment and a signed agreement, not through a website visit.

Is anything on this site medical advice?

Do the eligibility pages tell me whether someone qualifies?

No. Descriptions of eligibility rules are general information. Only an assessment and Medicaid's own review can determine whether a person is eligible, and nothing on this site is or implies such a determination.
